Indigenous Justice


Joshua Cooper has a piece in the Maui Time Weekly about Indigenous Justice, asking, "Will the world ever keep its promises?" Though most of the article is about international indigenous issues, he opens and closes with a Native Hawaiian connection, which I think is not necessarily that helpful. While Native Hawaiians are certainly indigenous, I have said here before and will say again, their main struggle and strength is based on issues of nationality and the political status of their country—Hawaii—rather than on their status as indigenous peoples, which provides no real legal foundation. The indigenous issues need to be worked out as internal policies of the country of Hawaii, but what sets Hawaiians apart from most or all other indigenous peoples in the world is the unique history of Hawaii as a recognized member of the world family of nations. To me, and to others involved in raising awareness about the occupation of Hawaii, including many Native Hawaiians, putting it in the indigenous context just creates confusion and from the international legal perspective has the potential to harm Hawaii's real path to restored independence.
