"Hawaii isn't a state"


Here's a case about a woman who was charged with tax related crimes, including "helping to prepare a return that claimed the foreign earned income tax exclusion on the premise that Hawaii isn't a state." Her boss was also convicted in 2001 of "filing tax returns claiming Hawaii as a foreign country." Interesting. There was another case back in 1994 or '95 in which John Marsh, a retired Honolulu Police Officer, was acquitted by a jury because of the absence of mens rea in willfully failing to file income tax returns. He argued that he truly believed that the Kingdom of Hawaii continues to exist and that the United States is occupying Hawaii, and that as a Hawaiian national he did not owe taxes to the United States. The jury found that even if they did not agree with his belief, his belief was still authentic, and thus he could not be convicted for willful failure to file.

Another letter in the Advertiser today in the Burgess vs. Burgess thread, this one in the "your lucky we're occupying your country" tone of condescension, without actually addressing the questions brought up by K. Burgess. The Hawaiian Kingdom also had freedom of the press with vigorous public debate in dozens of newspapers expressing points of view across the spectrum, in English and Hawaiian language. Slavery was outlawed and stopped in Hawaii long before it was in America. Even if you do believe America is "the greatest country in the world" (which is totally subjective - most powerful, yes; but greatest? not by many measurements) that does not give America the right to unilaterally impose its rule on another country.
